KROGER ASSOCIATES in WEST VIRGINIA RATIFY NEW LABOR AGREEMENT

CINCINNATI, November 9, 2007 – The Kroger Co. (NYSE: KR) said today it has been informed that members of UFCW Local 400 in West Virginia have ratified a new contract with the company.

"We thank our associates for their focus on serving our customers during this process. This is a good example of how fair and balanced agreements can be reached when the union and company leadership stay focused and committed to negotiating at the bargaining table,” said Jay Cummins, president of Kroger’s Mid-Atlantic division.

The four-year contract, effective immediately, covers 3,250 associates represented by UFCW Local 400 who work in 41 Kroger stores in parts of West Virginia, Ohio and Kentucky.

"This agreement provides wage increases and affordable quality health care benefits for our associates and their families and keeps Kroger competitive in the marketplace," Mr. Cummins said.

Headquartered in Cincinnati, Ohio, Kroger is one of the nation’s largest retail grocery chains.
